Last Will and Testament
A Last Will & Testament is a legal document that contains your personal instructions regarding the distributions of assets upon your death. A Last Will & Testament allows you to designate the beneficiaries of your estate and to name a person to serve as executor of your estate. A Last Will & Testament can be a very important planning tool for individuals with minor children or grandchildren, family members with special needs, concerns about long-term care planning and/or estate tax concerns.
A trust provision incorporated into the couple's Last Will & Testament can be effective in protecting assets from having to be used to pay for nursing home care when the surviving spouse is in a nursing home and receiving Medicaid assistance.
